After initially passing on the case, the Missouri Supreme Court has agreed to consider a Springfield-area case refused by public defenders due to caseload limits.
The case involving defendant Jared Blacksher of Sparta has bounced among appellate courts since Aug. 10, when Christian County Associate Circuit Judge John Waters overruled the defenders’ objections and appointed them to Blacksher’s case anyway.
The defenders and Christian County prosecutors will now file responses with the high court.
After first requesting a writ for prohibition with the Supreme Court, the public defenders were told to take their case to the Missouri Court of Appeals Southern District. On Sept. 1, the Southern District denied without comment the public defender’s request for a writ of prohibition.
