Appellate Practice: Criminal Case – Suppression Order – Timeliness

State v. Allen (MLW No. 59701/Case No. WD70295 – 7 pages) (Missouri Court of Appeals, Western District, Hardwick, J.)

Where the state appealed the suppression of a defendant’s statements in a criminal case, the interlocutory appeal of the suppression order was untimely because it was not filed until 57 days after the order, so the appeal must be dismissed.

Appeal is dismissed.

State v. Allen (MLW No. 59701/Case No. WD70295 – 7 pages) (Missouri Court of Appeals, Western District, Hardwick, J.) Appealed from circuit court, Boone County, Hamilton Jr., J. (Merilee A. Crockett, Columbia, for appellant) (Ellen H. Flottman, Columbia, for respondent).
