Civil Practice: Default Judgment – Set Aside – Notice

Stahlman v. Mayberry (MLW No. 59776/Case No. ED92654 – 4 pages) (Missouri Court of Appeals, Eastern District, Richter, J.)

Where a defendant in a civil action filed a motion to set aside a default judgment but failed to appear at a second scheduled hearing on the motion because he did not receive proper notice, the trial court’s judgment dismissing his motion is reversed.  

Judgment is reversed and remanded.
