Criminal Law: Post-Conviction Relief – Motion To Reopen – Jurisdiction

Even though a motion court erroneously dismissed for lack of jurisdiction a defendant’s motion to reopen his Rule 27.26 proceedings, the court reviewed the motion and properly found that the defendant did not make a claim of abandonment, and the defendant was not entitled to an evidentiary hearing.

Judgment is affirmed.
