Probate: Incompetent Ward – Sale Proceeds

Where a court ordered the sale of real and personal property to support a conservator’s incompetent ward, the balance of the identifiable proceeds of the sales belonged to the specified beneficiaries, and the trial court erred in ordering that the remaining funds generated by the sale of the trust assets be distributed only to the ward’s daughters pursuant to the trust’s residuary clause.

Judgment is reversed and remanded.

In the Estate of Mildred M. Honse (MLW No. 64656/Case No. SD31853 – 13 pages) (Missouri Court of Appeals, Southern District, Bates, J.) Appealed from circuit court, Maries County, Gaston, J. (Emily Lyn Woodward, Rolla, for appellant) (Albert Archie Crump Jr. and Amanda Lyn Grellner, Linn, for respondent).
