Criminal Law : Sentencing – Enhancement

Stephanie Maniscalco//February 10, 2014

Where a defendant in an unlawful possession case was sentenced to the statutory maximum of 120 months, the four-level enhancement for possession of a gun in connection with another felony is affirmed because the record showed that the district court properly applied the “facilitate” standard and the court also found that it was probable that the gun was connected to the drug offense.

Judgment is affirmed.
