Stephanie Maniscalco//March 26, 2014//

Listen to this article

Where a trial court dismissed several criminal charges against a defendant based on an alleged violation of the Interstate Agreement on Detainers, the defendant’s letter was not a sufficient request for disposition under the IAD because there was no certificate from the custodial officer and the request did not include the statutorily required information that should accompany the certificate.

Judgment is reversed and remanded.

State v. Bury (MLW No. 66201/Case No. SD32661/SD32662 – 10 pages) (Missouri Court of Appeals, Southern District, Sheffield, J.) Appealed from circuit court, Greene County, Fitzsimmons, J. (Kevin Timothy Young, Springfield, for appellant) (Margaret Mueller Johnston, Columbia, for respondent).
