Where Minnesota counties filed a class action against loan originators and servicers claiming that the lenders’ use of the Mortgage Electronic Registration System deprived counties of recording fees on mortgage assignments by allowing parties to bypass recording with the counties, the lenders’ motion to dismiss is affirmed because the district court properly found that the Minnesota Recording Act does not impose a mandatory recording requirement for all mortgages and subsequent assignments.
Judgment is affirmed.
