Employer – Employee : Work Comp Law – Exercise Of Rights – Contributing Factor

Where a worker argued that his exercise of his rights under Workers’ Compensation Law was a contributing factor in his employer’s decision to terminate him, summary judgment for the employer is reversed and remanded because its finding that the employee did not exercise any rights until after he was fired was erroneous.

Judgment is reversed and remanded.
