Criminal Law : Sentencing Enhancement – Felony Stealing – Cattle Theft

Where a defendant who was convicted of two counts of felony stealing in a cattle theft scheme challenged his sentence, the relevant sentencing enhancement was not applicable, and the defendant was entitled to a remand for resentencing under State v. Bazell, but the evidence was sufficient to support the convictions.

Judgment is reversed and remanded.
