Where appellant challenged the entry of judgment against him in an unlawful detainer action, the trial court did not err in finding that the appellant was not protected by the statute of limitations since the three-year period did not begin to run until the appellant was given notice to quit the property and he refused to vacate, and the award of restitution and damages was supported by the evidence.

Judgment is affirmed.
