Arbitration : Class Arbitration – Bilateral Arbitration – Threshold Question

Where in a dispute between a pharmacy benefits manager and four pharmacies, the pharmacies sought class arbitration and the manager argued that each pharmacy must engage in bilateral arbitration proceedings, the district court erred in concluding that the question of class arbitration was procedural rather than substantive, so the issue of whether an agreement allows class arbitration is reserved for the courts to decide.

Judgment is reversed and remanded.
