Domestic Relations: Paternity-Misrepresentation-Emotional Damage

Listen to this article

Where a father claimed his ex-wife fraudulently, negligently and intentionally misrepresented that he was the father of her three children when paternity testing eventually showed that he was not the father of the second child, the trial court properly dismissed the father’s attempt to recover emotional damages because Missouri does not recognize a cause of action for paternity fraud.

Judgment is affirmed.

Truong v. Truong (MLW No. 72366/Case No. ED106304 – 15 pages) (Missouri Court of Appeals, Eastern District, Odenwald, J.) Appealed from circuit court, St. Louis County, McShane, J. (Nathan S. Cohen for appellant) (Jonathan D. Marks for respondent).
