Administrative Law: Child Abuse Registry-Removal Of Name-Attorneys’ Fees

Staff Report//January 8, 2019

here the state challenged the removal of a mother’s name from the Child Abuse and Neglect Registry, arguing that she failed to provide proper support for her daughter after the daughter’s sexual abuse by her ex-husband, the judgment is affirmed because the state did not prove neglect by a preponderance of the evidence, and the trial court did not err in awarding attorneys’ fees to the mother because unusual circumstances supported the award.

Judgment is affirmed.
