Real Property: Unlawful Detainer-Disposal Expense

Staff Report//February 25, 2019

Where landowners, who prevailed in a wrongful-detainer action, challenged the trial court’s judgment waiving other claims related to the defendants’ occupation of the premises, the judgment was final for purposes of appeal, and the judgment is affirmed because the landowners waived any claims associated with the occupancy, and the trial court had the authority to declare personal property left at the premises to belong to the landowners for allocation of the cost of disposal.

Judgment is affirmed.

(MLW No. 72772/Case No. WD81785 – 12 pages) (Missouri Court of Appeals, Western District, Martin, J.) Appealed from circuit court, Jackson County, Grate, J. (Hugh L. Marshall, Kansas City, Missouri, for appellants) (Rick Davis, Olathe, Kansas, for respondents).
