Immigration Law: Withholding of Removal-Prior Conviction-Likelihood of Torture

 

Petitioner, a Salvadoran citizen, petitioned for review of the Board of Immigration Appeals’ dismissal of petitioner’s appeal of an immigration judge’s decision denying petitioner withholding of removal and relief under the Convention Against Torture and denying petitioner’s motion to reopen proceedings.

Where petitioner was ineligible for withholding of removal because he had been previously convicted of a serious crime and had presented insufficient evidence of a likelihood of torture or governmental acquiescence to same upon his return to El Salvador, BIA correctly denied petitioner relief.

Judgment is affirmed.
