Criminal Law: Officers’ Testimony-Exclusion-Batson Challenge

Staff Report//April 22, 2019

Where a defendant challenged the exclusion of evidence regarding the taser certification of two officers involved in the arrest, the trial court did not abuse its discretion in excluding impeachment evidence that was not legally relevant, and the judgment is affirmed because the court did not clearly err in overruling the defendant’s Batson challenge since the state asserted a racially neutral reason for a peremptory strike, which was not shown to be pretext.

Judgment is affirmed.

State v. Steele (MLW No. 73085/Case No. ED106450 – 12 pages) (Missouri Court of Appeals, Eastern District, Ransom, J.) Appealed from circuit court, Lincoln County, Ash, J. (Jedd Christian Schneider for appellant) (Garrick Aplin for respondent).
