Criminal Law: Bank Robbery-Career Offender-Guidelines Enhancement

Staff Report//June 3, 2019

Defendant pleaded guilty to bank robbery. The district court concluded defendant was a career offender, based on two prior federal bank robbery convictions, and imposed a two-level guidelines enhancement to sentence defendant to a within-guidelines range sentence of 151 months’ imprisonment.

Where bank robbery by intimidation qualified as a crime of violence, the district court did not err in classifying defendant as a career offender or in imposing a two-level guidelines enhancement.

Judgment is affirmed.
