A company whose driver had a seizure and killed the occupant of a vehicle stopped at a red light paid a settlement of nearly $5.9 million, according to the plaintiffs’ attorneys.
Johnny M. Simon of The Simon Law Firm said the plaintiffs were able to show the defendant driver had a history of seizures, and that his employer was negligent in entrusting him with a commercial motor vehicle and had failed to follow federal motor carrier regulations. Simon said the defendants argued the crash was an act of God, and that the federal motor carrier regulations did not apply.
Simon said the settlement totaled $5,897,983.13.
