Employment: Fair Credit Reporting Act-Dismissal-Stay of Discovery

Plaintiff appealed from the dismissal of his Fair Credit Reporting Act claim for failure to state a claim.

Where plaintiff’s proposed amendments were futile and where plaintiff could not obtain discovery absent a plausible legal theory, the district court properly dismissed plaintiff’s complaint.

Judgment is affirmed.
