Domestic Relations: Termination of Parental Rights-Abuse or Neglect

Mother appealed from the judgment terminating her parental rights to her child on grounds of abuse and neglect, failure to rectify conditions, and parental unfitness. On appeal, mother challenged the trial court’s findings of fact and argued that the decision was not supported by clear and convincing evidence.

Where there was clear and convincing evidence that mother had a mental condition that remained unacknowledged and untreated and that mother continued to engage in acts of abuse and failed to provide financial support, the trial court properly terminated her parental rights due to abuse and neglect and failure to rectify due to her inability to comply with her service plan that demonstrated that dangerous conditions would continue to exist for her child into the future.

Judgment is affirmed.
