Listen to this article

Where a defendant, who was convicted of sodomy and domestic assault, argued that the trial court erred in denying his motion for a new trial because the jury heard impermissible testimony from the victim about uncharged drug use, the testimony was isolated and unprompted, and evidence that the defendant used pain drugs was proper rebuttal testimony and not evidence of uncharged misconduct, and the judgment is affirmed because the defendant did not show juror nondisclosure.

Judgment is affirmed.

State v. Stafford (MLW No. 74171/Case No. ED107031 – 17 pages) (Missouri Court of Appeals, Eastern District, Odenwald, J.) Appealed from circuit court, St. Louis City, McGraugh, J. (Alexandria A. Shah for appellant) (Richard A. Starnes and Sabrina A. Lampley for respondent).
