Criminal Law: Supervised Release-Due Process-Sufficiency of Evidence

Staff Report//March 11, 2020

Where a defendant in a drug-possession case challenged the revocation of his supervised release, the district court had sufficient evidence to find that the defendant committed the violation, and even if the defendant’s due process rights were violated, he did not show how further disclosure from the government would have helped him, so the judgment is affirmed.

Judgment is affirmed.

U.S. v. Burrage (MLW No. 74619/Case No. 19-2090 – 7 pages) (U.S. Court of Appeals, 8th Circuit, Benton, J.) Appealed from U.S. District Court, Southern District of Iowa, Pratt, J. (Andrew J. Dunn, Des Moines, Iowa, argued for appellant) (Andrew H. Kahl, Des Moines, Iowa, argued for appellee).
