Criminal Law: Warrant Application-Probable Cause

Staff Report//April 20, 2020

Where a defendant challenged the denial of his motion to suppress evidence seized at his home, the district court did not abuse its discretion in denying a Franks hearing, and the warrant application was supported by probable cause, so the motion to suppress was properly denied.

Judgment is affirmed.

U.S. v. Turner (MLW No. 74732/Case No. 19-1191 – 7 pages) (U.S. Court of Appeals, 8th Circuit, Erickson, J.) Appealed from U.S. District Court, Southern District of Iowa, Rose, J. (Murray W. Bell, Bettendorf, Iowa, argued for appellant) (Kristin Elaine Olson, Des Moines, Iowa, argued for appellee).
