Appellate Practice: Contempt Finding-Finality Of Judgment

Where a judge appealed a trial court judgment finding him in contempt in a dispute arising from the judge’s order placing an elected clerk on administrative leave, the contempt judgment was rendered moot and unappealable when the judge purged himself of the contempt as ordered, and the appeal is dismissed for lack of a final, appealable judgment.

Appeal dismissed.

Allsberry v. Flynn (MLW No. 79544/Case No. ED110744 – 6 pages) (Missouri Court of Appeals, Eastern District, Page, J.) Appealed from circuit court, Lincoln County, Beetem, J. (Willard D. McCarter and Joseph Neely for appellant) (David M. Duree for respondent).
