Civil Practice: New Trial Order-Relief Granted

Staff Report//June 1, 2023

Where appellant challenged a trial court order granting a new trial in a case arising from an auto accident, the court granted all of the relief requested by the respondent upon alleged improper closing arguments, so the court abused its discretion in granting a new trial following the jury verdict.

Judgment is reversed and remanded.

Collier v. Steinbach (MLW No. 79961/Case No. ED110937 – 9 pages) (Missouri Court of Appeals, Eastern District, Page, J.) Appealed from circuit court, St. Louis City, Noble, J. (David P. Bub, Tyler J. Finnegan and Augustus T. Hayes for appellant) (Christopher J. Finney, Craig A. Schlapprizzi and Alexander L. Ledbetter for respondent).
