The state appealed the dismissal of murder, robbery, and armed criminal charges against defendant, arguing that prosecution on these charges was not barred by the parties’ deferred prosecution agreement.
Where the trial court’s order did not adjudicate all the counts in the indictment, the state lacked authority to appeal the order and the court was forced to dismiss the state’s appeal.
Appeal is dismissed.
