Staff Report//October 23, 2023//
Where appellant mining company challenged the dismissal of an application for a permit to conduct surface mining operations, the permit application did not identify all of the parties with any interest in the land and did not contain the written consent of all parties prior to approval, so the decision to deny the permit is affirmed, and resident appellants’ cross appeal is dismissed because they already received the relief requested.
Appeal dismissed.
