Criminal Law: Supervised Release-Violation of Conditions-Excessive Sentence

Defendant appealed the revocation of his supervised release and the revocation sentence, arguing that there was insufficient evidence to support finding that he violated the conditions of his supervised release by assaulting his girlfriend and that the district court imposed an excessive sentence.

Where the district court found defendant’s girlfriend’s testimony about the attack credible, there was sufficient evidence to revoke defendant’s supervised release, and his sentence was substantively reasonable where the district court adequately considered the statutory sentencing factors.

Judgment is affirmed.
