Defendant appealed the denial of its motion to compel arbitration of plaintiff’s employment discrimination and retaliation claims.
Where the parties disputed the existence of a valid arbitration agreement, the district court was empowered to decide the issue of arbitrability and was not obligated to refer the issue to arbitration.
Judgment is affirmed.
