The receiver moved for approval of the sale of publicly traded securities. The receiver was appointed for a private equity fund, with his compensation payable from the proceeds of receivership property. The receiver sought to sell 8,205 shares of publicly traded stock of a company, alleging that the stock price was volatile and that a sale would provide stable liquidity. Plaintiffs opposed, arguing that a limited sale of shares would better serve the fund.
Where a limited sale would preserve some value for the fund while also providing it with immediate liquidity for its operations, the court authorized the receiver to sell a limited number of shares, provided the share price was not below a specific threshold.
Receiver’s motion granted in part.
