Unemployment Compensation-Dismissal of Claim-Wrongful Termination

Plaintiff appealed the dismissal of her application for review of the previous dismissal of her claim for unemployment benefits, after a determination of unintentional overpayment to plaintiff, claiming that she was wrongfully terminated, that her untimely application was caused by excusable neglect, and that she was entitled to the overpaid benefits because she received them in good faith.

Where plaintiff failed to timely file her appeal after receiving notice of the dismissal of her application for review, the court was constrained to dismiss the appeal for lack of jurisdiction.

Appeal is dismissed.
