Criminal Law: Post-Conviction Relief-Ineffective Assistance of Counsel

Defendant appealed the dismissal of his motion for post-conviction relief as untimely filed without the appointment of counsel.
Where indigent post-conviction movants were entitled to appointment of counsel, the fact that defendant was represented by a public defender at trial was sufficient to establish his indigency, requiring the trial court to appoint post-conviction counsel.
Judgment is reversed and remanded.
