Consumer Law-TCPA-Unwanted Text Messages-Arbitration Agreement

Plaintiff appealed the grant of defendant’s motion to compel arbitration. Plaintiff had hired defendant for pest-control services pursuant to an agreement that contained an arbitration clause. Two years after its last service appointment, defendant sent plaintiff several text messages about autopay features and future appointments. Plaintiff filed suit alleging violation of the Telephone Consumer Protection Act and invasion of privacy, but the district court granted the motion to compel arbitration.
Where the text messages had a sufficient connection to the parties’ relationship resulting from their service agreement, the arbitration clause covered the parties’ dispute as it had no sunset clause.
Judgment is affirmed.
