Criminal Law-Declaratory Judgment-Credit for Time Spent in Custody
Staff Report//May 20, 2026//
Petitioner appealed the denial of his petition for declaratory judgment seeking a ruling that he was entitled to credit on his sentence in one county for time spent in custody in another county and in a federal penitentiary.
Where petitioner would have served time in the other county even if his present offense never occurred and where his federal sentence was unrelated to charges brought by the state, petitioner was not entitled to credit for time served.
Judgment is affirmed.
