Immigration-Asylum-Withholding of Removal-Particular Social Group

Petitioner sought review of the denial of her application for removal, withholding of removal and protection under the Convention Against Torture. Petitioner alleged that she was a member of the particular social group of persons who suffered violence or threats from gangs. However, the IJ ruled that petitioner’s group lacked the required visibility, particularity or social distinction and that petitioner failed to prove she would be tortured at the instigation or acquiescence of government officials if returned to El Salvador.
Where petitioner’s notice of appeal to the BIA failed to identify any erroneous findings of fact or conclusions of law by the IJ, the BIA did not abuse its discretion in dismissing the appeal.
Petition is denied.
