Criminal Law-Drug and Firearm Offenses-Drug Premises Enhancement-Downward Departure or Variance

Defendant appealed the sentence imposed following her guilty plea to drug and firearm offenses, challenging the imposition of a drug premises enhancement and the denial of her motion for a downward departure or variance.
Where the evidence supported finding that defendant maintained a drug premises and the district court did not have an unconstitutional motive in denying a downward departure, the court upheld defendant’s sentence.
Judgment is affirmed.
