Civil Rights-§1983-Official Capacity Claim-Sovereign Immunity
Staff Report//June 24, 2026//
Plaintiff appealed the adverse summary judgment granted in his §1983 action alleging official-capacity claims for damages and injunctive relief, along with individual capacity failure-to-protect claims.
Where the Eleventh Amendment barred damage suits against state officials sued in their official capacities, plaintiff could not assert an official capacity damages claim, and thus his claim for injunctive relief was moot.
Judgment is affirmed.
