A message from the provider: My passion is mediation. After 40 years of practicing civil litigation and handling thousands of cases, taking hundreds of depositions and trying cases with judges and juries in state and federal courts, I believe I have the experience to provide objective and impartial analysis, listening skills and feedback to the parties to help guide the parties to resolution. I have the following observations which barely scratch the surface of my thoughts on mediation. First, respect for the legal system, the parties and their attorneys is paramount. Second, being “neutral” is not, in my view, the appropriate term. It should be being “objective”. Third, every mediation involves a disciplined approach. Fourth, mediation and negotiation, regardless of the issues involved, are chiefly about human interaction. I have been recommended and used by Presidents of both MATA and MODL on many occasions. Message from the provider: Mediation and arbitration are no longer “alternative” dispute mechanisms. They are, and should be, mainstream. They are also not easy services to provide, and it is in the interest of the parties to learn what experience and traits they seek in the provider. One method, mediation, relies on self-determination of the parties, not their attorneys, in an atmosphere that should be cooperative not litigious.  This requires the mediator to work to provide the necessary safe environment. The other, arbitration, is a method of dispute resolution with finality, lessened costs, reduced discovery, and for fewer opportunities to appeal. Arbitration should make dispute resolution more accessible and affordable to the small and large party alike. This requires that the arbitrator avoid the parties’ temptation to make arbitration look like litigation.
