Your dispute can be mediated in a series of Zoom sessions, rather than one long 10 hour in- person meeting, or by a series of secure text exchanges through a mediation platform built to allow an ongoing discussion over a short but not continuous period of time. The availability of new processes is dependent only on your willingness to use them.
There is no reason you cannot settle any dispute you have, business or personal, through ODR. In the not-too-distant past, no one knew what Zoom was, texting didn’t exist, and many were reluctant to use mediation at all. All of these tools are now commonplace, but the way we use them will continue to evolve at the rapid pace of the electronic age. If you keep your mind open to these developments, they will make your life easier, save you money, and lessen the time you spend in dispute. Life is too short, as we are now painfully reminded.
ODR does not just encompass mediation, it can also be used for arbitration and early neutral evaluation. A neutral trained in the use of ODR, as I am, can offer you many different ways to approach a satisfying resolution to any situation. ODR is here to stay.
