Domestic Relations-Motion to Terminate Spousal Support-Due Process Violation

Plaintiff appealed the denial of her motion to set aside the judgment. The court noticed plaintiff’s motions for contempt and to dismiss defendant’s motion to terminate his spousal support obligation. However, the trial court ruled on defendant’s motion as well. 

Where the trial court failed to notify the parties that it would rule on the motion to terminate, it violated plaintiff’s due process rights.   

Judgment is vacated in part and remanded.
