Bankruptcy-Approval of Sale-Completed Sale-Motion to Dismiss Appeal

The trustee moved to dismiss debtor’s appeal challenging the bankruptcy court’s order granting approval of the sale of real estate. The trustee asserted that the sale of the subject real estate had already closed.     

Where debtor had not obtained a stay of the sale, the closing of the sale made debtor’s appeal statutorily moot.   

Appeal is dismissed.
