Federal trucking cases top list of settlements

Settlements reached in federal court cases made a surprising showing in the top settlements list this year, capturing the top spot and two other positions on the top 10.

Last year only two federal cases made the list of top 20 settlements in Missouri.

Leading the pack was the $18 million settlement in the , Western District of Missouri. The families of three women killed in a 2006 accident on Interstate 70 just outside Columbia brought the triple wrongful death case.

Three law firms from the Kansas City area represented relatives of the women. The $18 million settlement does not include a confidential settlement reached two weeks before the trial between the defendants and the family members of two other women seriously injured in the crash.

Other top settlements in federal cases also included deals struck with trucking companies over accidents. In one case in the Eastern District, a national transportation company agreed to pay $5 million to the family of a man killed when a tractor-trailer rear-ended his van.

In another Eastern District case, a trucking company agreed to pay $3 million to an elderly couple for brain and back injuries the husband suffered when a semitrailer hit the John Deere tractor he was driving.

Those figures rocketed the two federal courts to the top of the list when it came to the average settlement amounts for top courts in Missouri. The average settlement amount in the Western District in 2008 was $2.5 million, and the average settlement in the Eastern District was $1.52 million.

In venues that saw huge settlement amounts, Jackson County and St. Louis City circuit courts, the average settlement was $1.27 million and $1.29 million, respectively.
