Criminal Law: Statutory Sodomy-Accusations of Juror Misconduct

Defendant appealed from his conviction for first-degree felony . On appeal, defendant argued that the trial court erred when it made statements to two members of the jury identifying defendant and his counsel as the parties who had accused the jurors of misconduct during trial.

Where the trial court’s questioning of the jurors did not relate to defendant’s innocence or guilt or the truthfulness or importance of any evidence at trial or served to indicate the trial court’s contempt of defense counsel, the court found no error in the trial court’s statements to the jurors.

Judgment is affirmed.
