Criminal Law-DWI-Double Jeopardy

Staff Report//April 1, 2026//

Listen to this article

Defendant appealed her convictions for DWI. Defendant failed to stop at a stop sign and collided with another vehicle, injuring its occupants. Defendant tested positive for methamphetamine and was charged with class D and class E felony DWI. Defendant argued that her two DWI convictions arising from the same accident violated double jeopardy

Where each of defendant’s DWI convictions required proof that the other offense did not and arose from different victims with different injuries, there was no double jeopardy violation to convict defendant on both offenses.

Judgment is affirmed.

State v. Layton (MLW No. 84555/Case No. SD38797 – 12 pages) (Missouri Court of Appeals, Southern District, per curiam) Appealed from circuit court, Greene County, Stockard, J. (Ellen H. Flottman, Columbia and James Robert Hayes, Springfield for appellant) (Renee Christine Warden, Jefferson City and Zachary Scott McFarland for respondent)
