Domestic Relations: Dissolution-Motion To Set Aside-Proper Support

Staff Report//November 20, 2023//

Listen to this article

Where a husband challenged an amended judgment granting his ex-wife’s motion to amend or set aside a judgment of dissolution, the motion was not properly supported by affidavits or sworn testimony, and the trial court abused its discretion by improperly amending rather than vacating the portion of the judgment dividing the marital property, so the judgment is reversed.

Judgment is reversed.
