Defendant appealed the denial of his motion for post-conviction relief, challenging the sufficiency of the evidence supporting his conviction for tampering with evidence and alleging ineffective assistance of counsel.

Where counsel correctly assessed applicable case law to conclude that there was sufficient evidence to support convicting defendant for tampering with evidence, direct appellate counsel was not ineffective for advising defendant to drop the claim on appeal, and trial counsel was not ineffective for challenging the sufficiency of the evidence supporting defendant’s possession conviction where the evidence presented at trial demonstrated that defendant and other had gotten “high” off the methamphetamine he possessed.

Judgment is affirmed.
