Torts-Truck Accident-Liability Determination

Plaintiff appealed the adverse judgment entered by the trial court following the jury’s verdict that found neither plaintiff nor defendant at fault for the accident involving the truck driven by defendant’s employee.  

Where the trial court erred in admitting evidence of the employee’s driving record, as it only served to confuse the jury and improperly elicit sympathy for the employee, the court decided to reverse the judgment and remand for a new trial.    

Judgment is reversed and remanded.
