Criminal Law-Violation of Order of Protection-Scope of Cross-Examination
Staff Report//June 24, 2026//
Defendant appealed his conviction for violating an order of protection and resisting arrest, arguing that his cross-examination questioning was outside the scope of his direct examination.
Where defendant’s testimony about feeling threatened by victims opened the door to cross-examination about the petitions he filed against the victims and his actions during the incident underlying his charges, there was no error in permitting such cross-examination to impeach defendant with contradictions in his testimony.
Judgment is affirmed.
State v. Lee (MLW No. 84986/Case No. SD39159 – 9 pages) (Missouri Court of Appeals, Southern District, Nickell, J.) Appealed from circuit court, Carter County, Lynxwiler, J. (Ellen H. Flottman, Columbia for appellant) (Michael P. Hutchings, West Plains and Rizwan Ahad, West Plains for respondent)
