Where petitioners filed a writ of mandamus, seeking to vacate an order of the district court that granted a motion to strike a jury demand in a civil action, the demand could not be withdrawn without the consent of the parties, which was not given, and the petitioner satisfied the conditions for extraordinary relief, so the petitioner was entitled to the requested relief.
