Domestic Relations: Child Support-Abatement Of Payments-College Student

Where a mother appealed a trial court’s modification of child support that increased her monthly award but abated payments for eight months while the child attended college, the judgment is affirmed because the evidence supported a finding of redundancy between the child’s college and other expenses and mother’s expenses since the father was ordered to pay 95 percent of the child’s educational, living, recreational and other incidental expenses in addition to monthly child support.

Judgment is affirmed.

Sansone v. Fulton (MLW No. 80719/Case No. WD85717 – 14 pages) (Missouri Court of Appeals, Western District, Martin, J.) Appealed from circuit court, Platte County, Eckold, J. (Robert Peter Smith, Kansas City, MO for appellant) (David Bruce Sexton, Gladstone, for respondent).
